This is a legal agreement between you, the individual or entity 
that is downloading, installing and/or using the SOFTWARE, and 
ULTRAFISH.  DOWNLOADING, INSTALLING and/or USING the SOFTWARE 
indicates that you have read, understand and agree to be bound by 
the terms of this agreement.  If you disagree with this agreement 
then do not download, install and/or use this software. 

This ULTRAFISH Software License Agreement ("License") permits 
you to use the SOFTWARE produced by ULTRAFISH, on any of your
computers.  You may copy the SOFTWARE or provide copies of the 
SOFTWARE to anyone else, for any purpose.  You may not sell for 
profit or collect monies for distributing any copies the SOFTWARE 
to anyone.  You may not reverse engineer or decompile the SOFTWARE, 
unless explicit written permission has been granted to you by ULTRAFISH.  
If you breach any of the foregoing obligations, ULTRAFISH will 
be entitled to pursue all available legal and equitable remedies to 
protect its interests.

THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. 
ULTRAFISH DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED,  
INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY 
AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL OTHERS INVOLVED IN THE 
CREATION, PRODUCTION, OR DELIVERY OF THIS PROGRAM AND RELATED 
DOCUMENTATION. THE ENTIRE RISK AS TO THE RESULT AND PERFORMANCE OF 
THE PROGRAM IS ASSUMED BY THE USER.  SHOULD  THE PROGRAM PROVE 
DEFECTIVE, YOU (AND NOT ULTRAFISH, ITS EMPLOYEES, OR DEALERS) 
ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR 
CORRECTION.  FURTHER, ULTRAFISH DOES NOT WARRANT, GUARANTEE, OR MAKE 
ANY REPRESENTATIONS REGARDING THE USE OF OR THE RESULT OF THE USE OF
 THE PROGRAM IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, 
CURRENTNESS OR OTHERWISE, AND YOU RELY ON THE PROGRAM AND ITS RELATED 
DOCUMENTATION AND RESULTS SOLELY AT YOUR OWN RISK. NEITHER ULTRAFISH, 
ITS EMPLOYEES, OR DEALERS ASSUME ANY LIABILITY FOR FINANCIAL LOSS OR 
FOR ANY ACTIONS CAUSED BY FOLLOWING ANY PART OF THE PROGRAM OR RELATED 
DOCUMENTATION IN ANY INDIVIDUAL, GROUP, ENTITY, NEW OR EXISTING 
BUSINESS.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT
SHALL ULTRAFISH, ITS EMPLOYEES, DEALERS, OR DISTRIBUTORS SHALL BE 
LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY 
DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS 
OF BUSINESS PROFITS, BUSINESS INTERRUPTION,  LOSS OF BUSINESS 
INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF, 
RESULTS OF THE USE OF, OR INABILITY TO USE THIS ULTRAFISH PRODUCT, 
EVEN IF ULTRAFISH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES  
OR CLAIMS OCCURRING.  IN NO EVENT SHALL ULTRAFISH LIABILITY UNDER 
THIS LICENSE EXCEED THE PRICE PAID BY YOU FOR THIS LICENSE. THIS 
LICENSE IS FREE AND IS WITHOUT ANY CHARGE FOR USING OBTAINING AND/OR 
USING THE SOFTWARE.

This license is effective until terminated. You may terminate it 
by destroying all copies of the SOFTWARE from any storage media and 
from the user's computer system(s), SOFTWARE documentation and all 
copies thereof. This license will also terminate if you fail to comply 
with any terms or condition of this agreement. You agree, upon such 
termination, to destroy all copies of the program and documentation. 

This agreement embodies the entire understanding of the parties, and that 
you aknowledge that you have read this agreement, understand it, and agree 
to be bound by its terms and conditions. You also agree that this agreement 
is the completed and exclusive statement of agreement between the parties 
and supercedes all proposals or prior agreement, verbal or written and any 
other communications between the parties relating the the subject 
matter of this agreement. 

GOVERNING LAW: This license will be governed by the State of California 
as they are applied to agreements between California residents entered into 
and to be performed entirely within California.
